Terms of Service

These Terms of Service ("Terms") govern access to and use of MakeLayout (the "Service"), an embeddable product customizer widget operated by MakeLayout ("we," "us," "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

MakeLayout lets a business ("you," "Customer") embed a live product design tool on its own website, so that its own end customers ("Shoppers") can personalize products (e.g. add text, images, colors) before ordering. We provide the editor, the print-ready file generation, and the tools to manage products, orders and pricing. You remain responsible for fulfilling orders placed through your store — MakeLayout does not manufacture, print, ship, or sell physical goods.

2. Accounts and Plans

• You must provide accurate account information and keep your login credentials confidential.
• New accounts include a 14-day free trial. No payment is required to start a trial.
• Paid plans are billed monthly and renew automatically until canceled. Plan limits (such as the number of customizable products) are described on our pricing page.
• You may cancel at any time from your account. Access continues until the end of the current billing period; we do not provide prorated refunds for partial periods, except where required by law.

3. Payments

Subscription payments are processed by third-party payment providers, not by MakeLayout directly:

• Payments from Russian-issued cards are processed by Robokassa.

We never receive or store your full card details.

4. Acceptable Use

You agree not to use the Service to: violate any law; infringe someone else's intellectual property; upload malicious code; or design, sell, or facilitate the sale of products that are illegal, counterfeit, or that we reasonably believe are harmful, fraudulent, or abusive. We may suspend or terminate accounts that violate this section.

5. Your Content

You and your Shoppers retain ownership of any designs, images, text, and files uploaded to the Service. By uploading content, you confirm you have the rights to use it, and you grant us a limited license to store and process it solely to operate the Service (e.g. render the editor, generate print files, deliver orders to you).

6. Service Availability

We aim to keep the Service available and reliable, but we don't guarantee uninterrupted access. We may perform maintenance, and we may modify or discontinue features with reasonable notice where practical.

7. Disclaimer and Limitation of Liability

The Service is provided "as is." To the maximum extent permitted by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

8. Termination

You may stop using the Service and cancel your account at any time. We may suspend or terminate accounts that breach these Terms, with notice where reasonably possible.

9. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll notify you (e.g. by email or a notice on the site) before they take effect.

10. Governing Law

These Terms are governed by the laws applicable to our business's place of registration, without regard to conflict-of-law principles.
